1. Agreement to Terms
By accessing or using XOBO's software, APIs, and services (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Services. These Terms constitute a legally binding agreement made between you and XOBO.
2. Description of Services
XOBO provides a suite of customer growth tools, including but not limited to:
- WhatsApp Marketing Automation
- Loyalty and Referral Program Management
- AI-powered Customer Analytics and Feedback Parsing
- Smart Linktree and QR Code Generation
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.
3. Acceptable Use Policy
When using XOBO, particularly our messaging and marketing features, you agree to adhere to strict acceptable use standards:
- No Spam: You may only send marketing messages (e.g., via WhatsApp) to users who have explicitly opted-in to receive communications from your business.
- Compliance with Meta Policies: You agree to abide by WhatsApp's Business Policy and Commerce Policy. Violations may result in your WhatsApp Business API access being revoked.
- Prohibited Content: You may not use our Services to transmit illegal, harassing, defamatory, or explicit content.
Failure to adhere to these rules may result in the immediate termination of your account without a refund.
4. Subscriptions & Billing
Access to XOBO is provided on a subscription basis. You will be billed in advance on a recurring schedule (monthly or annually). By providing a payment method, you authorize us to charge the subscription fees automatically. Ensure your billing information remains accurate to avoid service interruption.
5. Intellectual Property
All copyright, trademarks, design rights, patents and other intellectual property rights in the XOBO platform, algorithms, UI/UX, and codebase shall remain vested in XOBO. You may not copy, reverse engineer, or resell the Services without explicit written permission.
6. Limitation of Liability
To the fullest extent permitted by applicable law, XOBO and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues (including loss of data, loss of business opportunity, or account suspension by third parties like Meta/WhatsApp) resulting from your use of the Services.
7. Changes to Terms
We may update these Terms from time to time to reflect changes in our Services or legal obligations. We will notify you of any material changes via email or an in-app notification. Continued use of the Services after such changes shall constitute your consent to the updated Terms.
